CEPES welcomes the modification of the Social Economy Law that facilitates the use of unemployment capitalization in the incorporation as partners to cooperatives and labor societies

CEPES, welcomes the modification of Law 5/2011, of March 29, on Social Economy, which allows the use of capitalization for unemployment in the incorporation as partners to cooperatives and labor societies. This modification, which is included through the third final provision of Royal Decree-Law 1/2023, of January 10, on urgent measures regarding incentives for hiring labor and improvement of the social protection of artistic people, published this Wednesday in the BOE, improves and expands the effectiveness of the single payment of unemployment benefit as a source of financing for incorporation as partners to cooperatives and labor societies.
  • This is the modification included through the third final provision of Royal Decree-Law 1/2023, of January 10, on urgent measures in terms of incentives for hiring labor and improving the social protection of artistic people.
  • The new wording of the regulatory text responds to the proposals presented by CEPES and is aimed at correcting some undesirable effects caused by the 2021 labor reform, which hindered or prevented this use of capitalization for unemployment in that case.
  • The president of CEPES, Juan Antonio Pedreño "values the measure very positively and points out that the capitalization of unemployment benefit, as a measure to promote employment, has a "capital" importance for both cooperatives and labor societies."

 

Madrid, 13 January 2023.  The Spanish Business Confederation of the Social Economy (CEPES), welcomes the modification of Law 5/2011, of March 29, on Social Economy, which allows the use of capitalization for unemployment in the incorporation as partners to cooperatives and labor societies.

This modification, which is included through the third final provision of Royal Decree-Law 1/2023, of January 10, on urgent measures regarding incentives for hiring labor and improvement of the social protection of artistic people, published this Wednesday in the BOE, improves and expands the effectiveness of the single payment of unemployment benefit as a source of financing for incorporation as partners to cooperatives and labor societies.

With this modification, workers with an indefinite employment relationship can request the single payment of unemployment benefit, without being legally unemployed, to acquire social capital of the company for which they provide their services, and acquire the status of working or work partners.

For CEPES, this modification corrects, through the modifications of articles 9, 10.1 and 11 of the Social Economy Law, some unwanted effects that had caused the labor reform of 2021, which hindered or prevented this use of capitalization for unemployment in the cases of incorporation as partners to cooperatives and labor societies.

The president of CEPES, Juan Antonio Pedreño  values the measure very positively and "points out that the capitalization of unemployment benefit, as a measure to promote employment, has a "capital" importance for both cooperatives and labor societies, "because it allows employed workers to acquire the status of working or working members,  by making available the necessary economic resources to be able to acquire the shares or participations of these entities of the social economy that, otherwise, they would not obtain, favoring, with it, the corporate relief and the sustainability of business projects over time".

The modification included in Royal Decree-Law 1/2023, of January 10, responds to the proposals presented by CEPES in recent months, which aimed to contribute to the consolidation and growth of existing cooperatives and labor societies, through the incorporation of their workers to the condition of working or working members,  "allowing the improvement of the quality and stability of employment".
