CEPES publishes the first Guide on responsible public procurement adapted to the new Public Sector Contracts Law

CEPES has published the first Guide that focuses its content on the promotion of public procurement with companies and entities of the Social Economy, and that is made following the guidelines of the new Public Sector Contracts Law, after its entry into force last month of March. The "Guide" has been developed with a practical and direct approach. It includes an analysis of the possibilities offered by the new legal framework and resolves the most common doubts in the bids. In addition, it incorporates, as a proposal, models of clauses that can be incorporated into public procurement documents with full legal guarantees.

• Analyzes in detail the normative panorama that emerged after the entry into force of Law 9/2017, on Public Sector Contracts, from a perspective aimed at promoting the participation in it of Social Economy companies.

 

• It is a practical and useful tool for the Administrations that want to effectively implement responsible public procurement policies, as well as for those Social Economy companies that intend to influence this matter.

 

• Incorporates model clauses that can be incorporated into public procurement documents with full legal guarantees.

(Madrid, April 9, 2018) .- The Spanish Business Confederation of the Social Economy has published the first Guide that focuses its content on the promotion of public procurement with companies and entities of the Social Economy, and that is carried out following the guidelines of the new Law on Contracts of the Public Sector, after its entry into force last March.

The 'Responsible Public Buying Guide and the Promotion of Public Procurement of Social Economy Entities and Companies' , elaborated with a practical and direct approach, includes an analysis of the possibilities offered by the new legal framework and resolves the most common doubts in the tenders.

In addition, it incorporates, as a proposal, models of clauses susceptible of being incorporated into the public procurement documents with full legal guarantees. The Guide accompanies each clause with its corresponding system for its verification and control of compliance, in a way that contributes to achieve the correct execution of public contracts by facilitating the work to the maximum people responsible for the drafting of the specifications and the verification of the correct execution of public contracts.

Responsible recruitment guarantee

The president of CEPES, Juan Antonio Pedreño , explained that "this Guide, which has generated great expectations, will become an essential tool to ensure responsible public procurement by administrations, in addition to encouraging the participation of companies of Social Economy in this matter ".

CEPES values ​​that Law 9/2017 on Public Sector Contracts will allow Administrations to manage in a more efficient and co-responsible manner, from the point of view of general interest and economic rationalization,the budgets destined for public procurement, which represents close to 20% of the national GDP .

"The Social Economy considers that the new regulatory framework is an excellent opportunity to incorporate social criteria, in a transversal and mandatory way, in public procurement," said Pedreño.

The president of CEPES has stressed that "we defend that public procurement should be used to place the Administrations in a plan of innovation and commitment to quality employment, with equality of women and men, with social cohesion and with people more disadvantaged. " "For this," he added, "the public interest and citizens' needs must be incorporated in a cross-cutting and mandatory manner in the bidding and awarding of contracts, and this way the Administrations can demonstrate that responsible public procurement, in addition to ethics and law, it is efficient from the economic point of view ".

The companies and entities of the Social Economy are excited and hopeful before the scenario that should generate a new model in the use of public procurement in Spain, and hope to contribute their contributions to a system that is not a mere rhetorical declaration of intentions, but to be structured in a binding manner through the express and transversal mandate established by the new one.

CEPES, as Spanish employer of the Social Economy, worked with the parliamentary groups to reach the highest degree of consensus and possible agreement in this Law. As a result, several social advances and encouragement of responsible contracting in the law were established. finally approved with respect to the initial legislative proposal that began its journey more than two years ago.
